Mr.
Creager presented the following:
PROJECT INITIATION
This drainage
improvement was initiated through a single county drainage
petition filed by Mr. Lawrence Storeholder and others on March
16, 2009. The petition calls for the cleaning and brush
cleaning of portions of two open ditches known as Branches 1 and
1a of Fewless Creek located in Swancreek Township, Fulton
County, Ohio. A viewing of the project was conducted by the
Board of County Commissioners on Monday, April 13, 2009.
Improvements of
record in this watershed date back to 1884. The channels under
consideration at this time were cleaned through county drainage
petitions in 1901, 1943 and 1958. Since 1958 the channel has
been maintained privately by the adjacent land owners.
PROJECT OBJECTIVES
The primary
objective of this project is to clean the open ditches and
establish a permanent ditch maintenance program for the
channels.
PROBLEMS
OBSERVED
The problems
observed on the day of the viewing were consistent with what one
might expect see on a ditch in need of maintenance. Brush
covers both banks and the channel is filled with sediment.
WORK PROPOSED
The ditch will
be improved using one-sided construction techniques. Brush and
trees on channel banks that interfere with channel flow will be
removed. Sediment will be excavated from the channel bottom and
spoils will be leveled in adjacent fields. Filter strips and
roadsides will be restored. Erosion control measures will be
incorporated in the work plan.
CONSTRUCTION ESTIMATE
The estimated
cost to clean Branch 1 of Fewless Creek is $74,000. The
estimated cost to clean Branch 1a is $6,000. These estimates
include engineering and administrative costs. Upon completion
of the project work plan, actual assessments will be prorated to
reflect the final cost of the work completed.
PROJECT BENEFITS AND ESTIMATED
ASSESSMENTS
Assessments for the proposed improvement
will be based on the benefits received from the drainage
improvements. It is expected that the benefits derived from the
proposed improvements over their estimated 20-year useful life
will be $200,000.000 and will exceed the estimated project
costs. House lots and the rights-of-way will be assessed at
higher rates than agricultural land. Woods and pasture land
will be assessed at a lower rate than tillable land. Estimated
assessments could range from $120.00 to $60.00 per acre for farm
land depending on location.
MAINTENANCE
The Ohio Revised Code requires that all
drainage improvement projects be placed on a permanent
maintenance program. Maintenance activity is limited to the
maintenance of the items originally constructed. Maintenance is
paid for by periodic ditch maintenance assessments to the
parcels in the watershed. The amount of the maintenance
assessment is in proportion to the original ditch assessment for
each parcel.
The revised code provides for the right
of access to drainage lines and open ditches to perform
maintenance activities. The permanent maintenance access
easement for the improvement will be twenty-five (25) feet in
width measured from the top of the channel banks.
Mr. Creager stated that this area is more
residential than most petitioned areas. He calculates a benefit
for each parcel based on many factors, including house lot
acreage, tillable acres, pastures, woods, and right-of-way. The
cost of this project is being estimated at $74,134.56, while the
total benefits are $194,095.27. He presented the Board with a
breakdown of tentative assessments and a map showing the
highest. He further presented the board with a listing of the
parcels with special assessments for brush removal and culverts.
Commissioner Genter stated that he is in
favor of spreading the specials over the entire project, with
the exception of culverts. The Board agreed. Mr. Creager
stated that he will run that while computing final assessments.
Mr. Creager requested an extension to
compute final assessments and to forward the plans to ODNR.
Commissioner Barnaby made the motion. Commissioner Short
seconded the motion. Motion carried unanimously. The
continued date to file plans on Ditch 2107 has been set for
March 25, 2010 at 10:00 a.m.
Mr. Creager further requested an
extension of time to file the plans on Ditch 2109-Anderson as
the final design still needs completing and assessments
calculated. Commissioner Short made the motion and Commissioner
Barnaby seconded the motion. Motion carried unanimously.
The continued date to file plans on Ditch 2109 has been set for
April 1, 2010 at 10:00 a.m.
