Resolution 2009-494 Authorize §124.34 Order of Removal of a Public Employee

Mr. Votava explained that Nathan Howard, Transfer Station Operator, has been investigated for having drug paraphernalia in a county vehicle.  The employee was sent for a reasonable suspicion drug test and found positive for marijuana.  Thereafter Mr. Howard was served with charges and properly given notice on May 20, 2009 of a pre-disciplinary hearing. The hearing took place on May 26, 2009 and Mr. Howard was represented by counsel.  His counsel gave a statement on his behalf, Mr. Howard did not.  After the hearing, Mr. Votava, as the hearing officer, wrote up his report and indicated that he felt Mr. Howard was guilty of the charges and gave the report to County Administrator, Vond Hall, for his consideration.

 

Mr. Hall stated that after reading the report and taking into the consideration the risk that the public was put at based on the condition of the employee, he finds it appropriate to recommend to the Board Mr. Howard’s immediate removal.

 

Commissioner Barnaby stated that it is important to promote safety in the county and it is of utmost concern for the employees and residents.

 

Commissioner Short agreed stating that the employee was driving a county vehicle & putting the public at risk, a poor decision on the employee’s part.

 

Commissioner Barnaby made the motion and Commissioner Short seconded the Motion. Motion carried unanimously.
