View of Ditch 2107-Storeholder

Commissioner Short convened the view at the site of the proposed improvement at County Road 3, between Roads D & E, with Commissioners Genter and Barnaby also present, together with Rod Creager and Brinda Miller from the Fulton County Engineer’s Office and various landowners. 

 

Commissioner Short turned the view over to Rod Creager, Chief Deputy Engineer.  Mr. Creager explained that a petition had been filed for drainage improvements and presented an aerial map of the proposed improvement area.  He explained the ditch petition process as prescribed by the Ohio Revised Code.

 

Mr. Creager then asked if anyone had questions.  Two landowners expressed concerns that according to the map, the proposed improvement did not include work on their property.  Mr. Creager explained that work on their property was not part of the petition however their property does drain into the ditch.  They would be assessed for the portion that drains into the ditch even if no work was performed directly on their property.  He further explained that if the landowners wished to have work done on their parcel, the petition could be extended to include their property.  Neither landowner expressed interest in having the petition extended at this time. 

 

Mr. Creager explained how the cost is calculated for each landowner including special assessments.  He further explained that after the project is completed, it would be put on a maintenance plan.

 

A landowner alleged that the petitioner’s tiles are damaged and that is what is causing his problems.  Mr. Creager stated that would be looked into while preparing his preliminary report.

 

A landowner asked what is the final determining factor to approve the petition.  Commissioner Genter stated it is if the benefits exceed the costs.  Commissioner Short added that the need is factored in also. 

 

Various landowners expressed concern of how much would be removed and another expressed concerns with tress that are located on this property.  He asked if the County would consider coming to his property to look at the area.  The Commissioners agreed.

 

Mr. Creager stated that he would be back to the area in a day or two to take pictures of the area to begin his preliminary report to present to the Commissioners during the 1st hearing scheduled for April 30, 2009 at 11:00 a.m.

Mr. Creager stated that there were no recent recording of this area being dipped out.  It had been handled privately in the past.

 

Mr. Storeholder, the Petitioner, explained the issues that he was having in the area.

 

Another landowner asked if stimulus funding or grant money was available for these kinds of projects.  Mr. Creager explained that there is not.  The Ohio Revised Code prescribes that the landowners are responsible for the improvements.

 

Various landowners expressed concerns regarding assessments.  Mr. Creager explained the process of assessments, and further explained that he will not have any amounts until he can take a better look at the area and complete his preliminary report.

 

Mr. Creager stated that he would be back to the area in a day or two to take pictures of the area to begin his preliminary report to present to the Commissioners during the 1st hearing scheduled for May 4, 2009 at 10:00 a.m.
