9:06:20 AM	Resolution 2007-754 Approve Agenda as amended or presented		Agenda was amended to include a Water District Meeting in Swancreek Township September 11th at 6:30 pm. Commissioner Genter made the motion to approve the agenda as amended and Commissioner Barnaby seconded the motion. Motion carried unanimously.

9:07:41 AM	·Ziad Musallam, Sanitary Engineer discuss Riviera MHP Sanitary Sewer		Ziad Musallam was present to address the Board regarding a 2nd  hearing for CDBG Project, the Riviera Mobile Home Park Sanitary Sewer Project, to review the program itself and the project details. After checking the calendar and discussing dates to publish notice of said hearing Commissioner Genter made the motion to set October 1, 2007 at 10:00 am. as the date for the 2nd hearing and Commissioner Barnaby seconded the motion.  Motion carried unanimously. Commissioner Genter made the motion to table this resolution until the original contract arrives. Commissioner Barnaby seconded the motion.  Motion carried unanimously.

10:01:30 AM	FINAL HEARING DITCH 2101 GRIESER		Chief Deputy Engineer, Rod Creager, was present to give the final presentation.  He started with an overview of the last formal hearing in this matter and stated that it was continued at that time due to special assessments to the landowners and their request to pursue other means to accomplish the clean out.  Mr. Creager presented before and after photos of the work that has been done thus far by the landowners.  He then handed out proposed plans to the Commissioners for their review and consideration.  He stated that there is no change in the scope or intent of the work and that the regular assessments will not change, only those that had a special assessment.  Mr. Creager opened up the meeting for testimony from the landowners.  He then explained the process that the ORC dictates that the county must follow through this process of collecting assessments.  Ditch maintenance was discussed and he explained that the maintenance fee is only collected when the work is needed and the landowner is notified ahead of time.  The hearing was then closed for deliberations by the Commissioners.   After deliberation, Commissioner Barnaby moved to approve the petition and Commissioner Short seconded the motion. Motion carried unanimously.  Resolution 2007-772  Finding Affirming the Former order, Confirming Assessments, and Ordering the Letting of the Contracts.  Commissioner Genter made the Motion to allow a 5 year pay back on assessments involved in this matter and Commissioner Barnaby seconded the motion.  Motion carried unanimously.  Resolution 2007-773.

11:06:09 AM	· Resolution 2007-770 Approve Executive Session to consider the compensation of a public employee or official		Commissioner Barnaby made the motion to go into executive session to consider the compensation of a public employee or official and Commissioner Short seconded the motion. Roll call vote – Genter, yes; Barnaby, yes; Short, yes.  Motion carried unanimously.
