Commissioner Barnaby mentioned that all had been cleaned up from the Homecoming except for the tent and further mentioned that they ran out of chicken at 3:00 pm on Saturday.

Final Hearing on DeGier Ditch Petition -Commissioners Session Room

Commissioner Barnaby began by swearing in all that intended to speak at a time when testimony would be taken. He then stated that Commissioner Short; County Engineer, Frank Onweller; Assistant County Engineer, Rod Creager; and he had re-visited the site earlier in the morning.

 

Mr. Creager then began a PowerPoint presentation explaining the ditch process, the prayer of the petition and the nature and extent of the work proposed. He further addressed the process by which the assessments were calculated by explaining the REACH method.  This method involves all property owners that will benefit from the work and are assessed in the percentage in which it is used by them accordingly. He addressed further questions regarding assessments before Commissioner Barnaby called for testimony from the landowners:

 

Homer Durbin stated that he is against the 1st part of the petition but is for having the trees taken down and the ditch cleaned out.

 

Chad Helmniak stated that he is against the 1st part of the petition and proposed first cleaning out the brush and taking down the trees only.

 

John Snyder stated that he is against the 1st part of the petition.

 

Jim Reigsecher stated that he does not feel that the 1st part of the petition will benefit anyone.

 

Albert Case stated that he is for taking out the trees but is against the rest of the petition.

 

Lisa Snyder stated the she does not see any evidence of flooding on her property and further does not feel that they will benefit from part 1 of the petition.

 

Jeff DeGier, the Petitioner, recapitulated the expenses that he has incurred trying to solve this problem on his own before involving the County.

 

Shawna Helminiak and Lisa Snyder both expressed concern that their voice was not being heard throughout these hearings. The Commissioners explained that this is the 3rd hearing on this matter and that each time, because of the testimony given by the landowners, the original plan has been scaled back to reduce costs to all those involved.

Testimony closed-deliberations

After deliberations, it was decided that while it is agreed that this may not solve all of the problems, they must address the prayer of the petition which relates to surface drainage only.  The Commissioners believe that the proposed work is in the best interest as it relates to the prayer of the petition and further is the least expensive way to accomplish this.  Commissioner Barnaby moved to approve the petition and Commissioner Short seconded the motion. Motion carried unanimously.  Resolution 2007-604  Finding Affirming the Former order, Confirming Assessments, and Ordering the Letting of the Contracts.
