Commissioner Barnaby made the motion and Commissioner Short
seconded the motion. Motion carried unanimously
Commissioner Barnaby noted a 10:00 appointment with City of
Wauseon and Fire Chief. Commissioner Genter noted an executive
session for discipline of a public employee or official and also
the Commissioners will be touring Fulton Processing.

Ziad Musallam, Fulton County Sanitary Engineer, Dan
Bruner, Fulton County Soil & Water, and Randall Beck, Property
Owner - Discuss Access Through Pettisville Sewer Property

Mr. Musallam said this issue has been discussed
several years ago but at that time Mr. Beck did not own the
property north of the Pettisville lagoon. He does own the
property and is requesting access to cross the drive for the
purpose of taking care of his cattle.
Mr. Bruner discussed the pasture managment program that Mr. Beck
is participating in. Mr. Beck would like to put a crossing in
over the ditch and place posts on his property - nothing would
be on the county property. Cattle would not cross unless Mr.
Beck was there. Mr. Bruner said this access requested would only
encompass 20 feet but he doesn't know if that would be wide
enough to get equipment back in there...30 to 40 feet would be
good. Mr. Beck estimated the cattle would cross probably every
21 days although his daughters have horses and they could
possibly use this crossing as well. Commissioner Short commented
on a concern of equipment crossing - a liability issue. Mr. Beck
said that it would not be tractors - only what it takes to drive
the cattle across. Commissioner Genter said that the gates would
have to remain closed after use. He added that he prefers a
culvert type crossing. He expressed that they work with the
Engineers' office to accomplish the crossing. An access
agreement will be drawn up. Mr. Musallam said that the lagoon
will have to be emptied and the sludge disposed of. Mr. Bruner
said there is ample land available with permanent pasture.
Commissioner Genter said that the Board does not have a problem
with this; they only want to make sure that this is just a
livestock crossing and not equipment. Commissioner Short noted
also that this could set a precedence for the county.
Commissioner Genter also said that the Board would like the
fence set back far enough to allow the 40 feet or so that would
be needed. Damage responsibility will be covered in the
agreement. This agreement will be drafted and presented back to
the Commissioners for their approval.

Review for Request for Extension of Time from Lingvai
Excavating for Elmira/Burlington Sanitary Sewer Project

This request is due to weather delays. The
completion date was agreed to prior in the contract and agreed
upon by Lingvai. Mr. Musallam said that he estimated they were
only delayed 16 days for weather and that would be the only
extension the county would grant. He added that it is up to the
Commissioners to grant. Lingvai is requesting 45 days.
Commissioner Short asked what the additional time was for. Mr.
Musallam said pump delivery was part of the issue and explained.
Commissioner Genter said he would propose 20 days, or to the end
of the month. Ziad will prepare a change order. |

Mr. Eldridge presented his reports. He explained
that he may later propose moving some of the RLF monies so that
they might be used for infrastructure. If the monies set unused
the state may request them back and Mr. Eldridge would rather
see the dollars stay in Fulton County.

seconded the motion. Motion carried unanimously
Mr. Eldridge said there has not been much request for the
Microenterprise RLF and this money may have to go back to the
state.
