Terry Willeman - Discuss Right-of-Way in Oakshade |
Mr. Willeman reviewed the plat with the
Commissioners. He indicated the railroad right-of-way goes right
through several buildings and wanted to know if something
couldn't be done to correct that. Commissioner Graf said that he
had researched this issue and what the property owners thought
had been deeded to them actually had not. In a meeting the other
day, Frank Onweller found that a portion of Railroad St. had
been vacated but not all of it. Commissioner Graf reported what
he had found in his research. In 1980 a resolution was done to
purchase property right-of-way from the railroad and there is a
deed. A letter to the Chesterfield trustees in 1983 stated it
was not a dedicated right-of-way. The Chesterfield trustees
never followed up on that. No records were found in the
Commissioners' records or the Engineer's to indicate that it had
been done by the trustees. Commissioner Graf said he did not
beleive that it would be in the County's best interest to
abandon the right-of-way. Making it a township road might be the
way to go, which is what was discussed in 1983. Discussions with
the trustees is suggested to follow up and get the issue
resolved. Mr. Willeman expressed concern about trash dumping and
speeding occurring back there now. Commissioner Graf added this
is another reason the trustees need to get involved. A survey to
establish points will be necessary to determine what portions of
buildings, if any are on the right-of-way. The best solution
again is to dedicate this officially as a township road and then
to start discussions to abandon Railroad St. Mr. Willeman said
he would prefer not to open it up because it's bad enough right
now. He asked that he be kept posted on how this proceeds. |
