Ziad Musallam and Jan Burkhard - Discuss Elmira/Burlington
Project and Review Sewer Use Draft Resolution
|
Mr. Musallam presented a draft resolution of
sewer regulations and uses for the county. He reviewed it
briefly, hitting the highlights of the resolution for discussion
purposes. It started with definitions taken from the Clearwater
Act. Article II covered use of public sewers required. Article
III - building sewers and connections. Section 2 under Article
III drew discussion over requirement of a license in order to do
sewer taps. Five years experience would be required in order to
obtain a license. Mr. Musallam stressed that this could assure
that the taps are done right. Yearly license fees were not
something the Commissioners felt comfortable with. Performance
bonds could be required for certain jobs in lieu of this
licensing. Commissioners Graf and Genter both said they were
against licensing. Mr. Musallam agreed to take that out of the
resolution. Article IV - use of public sewers. Article V -
control of industrial wastes. Article VI - protection from
damage. Article VII - powers and authority of inspection.
Article VIII - penalties. Article IX - validity. Article X -
resolution in force. With regards to penalties, Commissioner
Graf asked the question if they as Commissioners have authority
by Statute to impose fines. Mr. Musallam said he believes that
they do because of damages. Commissioner Graf thought the
resolution ought to state that specifically and that a person
would be assessed individually for any damages. Commissioner
Genter agreed. If it is allowable by Statute then that authority
should be specified in the resolution. That section 2 will be
looked at further. Mr. Musallam stressed that this is not a
final resolution but only a draft. Commissioner Graf cautioned
Mr. Musallam that the Commissioners are not governed the same as
municipalities. Mr. Musallam will work on it and will present it
at a later date, possibly Thursday. Legal counsel will be sought
as well. Mr. Hall said he did not see any need to rush. Eastman
& Smith was one suggestion.

Resolution 2006-139 Designate Authorized
Representative to Sign All WPCLF Documents for the
Elmira/Burlington Wastewater Collection and Treatment Project
and Authorizing Said Representative to Enter into WPCLF
Agreement with OEPA/OWDA

Jan Burkhard will be the authorized
representative.
Commissioner Genter made motion to approve
Seconded by Commissioner Barnaby. Motion carried 2 to 1 with
Commissioner Graf abstaining. |

Ziad Musallam - outstanding issues from last week |
Mr. Musallam informed the Commissioners that the
EPA is now saying they will allow leachate from the landfill to
be hauled to the Pettisville lagoon with a special permit. Cost
will be researched by Mr. Musallam before taking any action.
Northeast Fulton County water supply - Mr. Musallam has spoken
with Congressman Gillmor and Senator DeWine for possibility of
funding. The EPA could stand in between obtaining federal
funding. Mr. Musallam will preceed with the grant application.
