9:03:38 AM Shawn Ferguson, Economic Development - Present Fulton County Processing Payment Schedule for St. Rt. 109 Sewer Line



Resolution 2005-172
Mr. Ferguson presented the Tax Incentive Donation Agreement for Fulton Processing to pay for the extension of the sewer line on Rt. 109. Their payment will be due one month prior to the county's payment date to OWDA. The first payment for the county will be July 1, 2005.

To Enter into the Agreement...Commissioner Graf made motion to approve. Seconded by Commissioner Barnaby. Motion carried unanimously.

This grant of $50,000 is to be used for LMI small business start-ups. As of this date there have been no applicants. Ms. Arend stated their office is actively pursuing applicants so

Richard Watkins resigned and the director will be researching new member suggestions for the board.
9:44:23 AM Review Correspondence from Henry County Regional Water & Sewer District regarding Bulk Water Purchase Agreement
Ziad Musallam was present for the discussion. He indicated that he had priorly been invited to a meeting at Henry County to discuss this issue. They would like to purchase water from the City of Wauseon as a bulk sale and then Henry County would then sell the water to northern Henry County. He stated that he would need to have the Fulton County Commissioners's approval before this could proceed. Commissioner Graf asked if this would be approximately 2 miles. Mr. Musallam said yes if the line would be installed on the abandoned railroad bed. Commissioner Graf asked if Henry County would bear the expense of this. Mr. Musallam said they are prepared to do that. Commissioner Barnaby asked what Mr. Musallam thought. Mr. Musallam responded that the need is really from the dairy farm. He added that he made Henry County aware of the fact that even if the line were to be installed it would still be based on the ability of Wauseon to provide what is needed. Commissioner Graf asked what would happen if Henry County were to then take the line to Gerald. He also asked if Wauseon would grant permission for the line. Mr. Musallam said that he has told Henry County that it would all be based on the agreement of Wauseon and of Fulton County. Commissioner Graf asked if Mr. Musallam was in favor instead of going down Road 15. Mr. Musallam said no, that it wasn't the desire of Fulton County to encourage development in that area. He added that Henry County expressed the desire for 12-inch mains and that he also told them they would be responsible for the design etc but at the supervision and approval of Fulton County. All the terms and conditions will have to met with all three parties involved - Henry County, Fulton County and the City of Wauseon. Commissioner Graf said he just didn't want to get in the same situation as what happened on 20A. He commented he would be more likely to approve the line down the railroad bed rather than down Road 15.

Mr. Musallam said the request is for discussions regarding this issue. Commissioner Graf said that he feels that Mr. Musallam understands the thoughts and wishes of the Commissioners and could facilitate these discussions on their behalf at this point. Mr. Musallam said he would set up a meeting with Henry County and Wauseon.
10:00:50 AM Rod Creager, Chief Deputy Engineer - Engineers Report on Ditch 2100 (Chambers)

Resolution 2005-171 to extend the Engineers Report to June 23, 2005 at 10:15 a.m.
Mr. Creager presented a request for extension on this project. He gave a brief overview of what has transpired so far.

The date is April 14th with a RSVP date of March 22nd. Lou Moody will be contacted to see if she has more insight on this day and what might be in order.

10:20:35 AM Ziad Musallam, Sanitary Engineer - Review Correspondence regarding the Current Assumption Waterline Deferred Assessment
A letter has been received from a representative of Simon Land Company. Mr. Musallam explained the situation for the Commissioners. Simon Land Company is interested in selling some lots and has been advised they would have to pay an assessment for water. They have been advised by Metamora that that there are no water taps available.

He said that there is a contract with the Village of Metamora done in 1998 allowing 20,000 gallons per day. Metamora has declined additional taps even though Mr. Musallam has calculated that there should be 8 remaining taps available. He has asked Metamora if these 8 taps might be reconsidered by the Village especially since we are not even meeting the 20,000 gallons per day. Mr. Hall said he believes a letter to the Village would be in order asking them to honor the terms of the contract.

Mr. Hall also presented a letter on behalf of Marion Onweller stating she has paid a tap all these years but opted to wait and install the tap when the lot would be developed. She is now being informed that the tap is not available for this parcel.

Letters will be sent to the council and also to their water board telling them to honor the contract. Mr. Hall and Mr. Musallam will draft the letter.
