There are three terms due to be reappointed. Ken Baumgartner, Joe Sevenich, and Brett Kolb are the appointees. Mr. Sevenich cannot serve another term and Mr. Kolb does not wish to be reappointed. Commissioner Barnaby stated for the record that all have done a fine job. The Commissioners will run an ad for the open positions. Commissioner Barnaby moved to reappoint Ken Baumgartner. | 9:08:27 AM | Continue Discussion of Prior Board Action regarding Sanitary Sub-Districts | Mr. Musallam reported on his findings after a further investigation of county records. A resolution was found declaring Pettisville a sub-district - Oct. 11, 1977. It stated that Pettisville has its own boundaries and that any funds collected need to stay in that district and cannot be used anywhere else. Also throughout the search, Mr. Musallam said that it was found that Pleasant View was also a separate sub-district. He has not found any board action that re-defined these districts in whole county district. Commissioner Barnaby asked what the law says. Mr. Musallam said that the law says the county is responsible for the health and well-being of the people. Commissioner Genter felt that the resolution clearly states Pettisville is their own district. Commissioner Graf said that by statute the county is the county-wide district. Mr. Musallam said the other issue searched went back to 1977 to present, and said that all special assessments have been declared by the board of commissioners. He said it is a matter of how they want to handle the issue, whether establishing sub-districts or separate entities. Commissioner Genter asked if Mr. Musallam is saying that the 1977 resolution is null and void. Mr. Musallam said no. Mr. Musallam said that the combining of the districts for the sake of assessments cannot be done the way it is set up right now. Commissioner Graf asked if a resolution could be done to change that. Mr. Musallam said that it would involve the public and a re-survey of all the sewer distrcits. Commissioner Graf asked if Mr. Musallam did not just say that the county is a county-wide district. Mr. Musallam said that is only for the health and well-being of the people. Commissioner Genter stated he does not feel that the separation is a good idea but that the problem today needs to be addressed first. Commissioner Graf said that former commissioners always talked of a combined water and sewer district and believed that indeed there was a county-wide district. Mr. Musallam said that there were no resolutions establishing that but he was under the understanding of that. Mr. Hall agreed. Commissioner Graf asked if Mr. Musallam found anything on the airport. Mr. Musallam said he had not found any action on that but he is still looking. Commissioner Graf said that when the board looks down the road, they need to establish a county-wide district involving research and surveying. Mr. Musallam said it is not establishing but reorganizing. Commissioner Genter said that he would like a legal opinion before moving ahead. Mr. Musallam agreed that would be the best way. Commissioner Genter questioned the abolishment mentioned in a prior resolution. Mr. Musallam stressed that this issue came up only because they felt that there is a county-wide district. Mr. Jeff Robinson said that he did not think there needed to be surveys done, in his opinion. He said that the state code stipulates that commissioners are in charge of the well-being of the county citizens. He also stated that the decision made by an earlier board could not be abolished. Mr. Robinson said that he has spoken with the county prosecutor about the issue. He said that he believes that the code speaks that counties cannot establish sub-districts. Commissioner Graf said they are not going to get this issue solved today. He does not believe that in the future they can have 50 sub-districts. He asked Mr. Musallam to do further research as well as the county prosecutor. These issues are going to get more complicated all the time. Commissioner Genter said he believes that each entity should be responsible for their own. Commissioner Barnaby moved to approve the Resolution 2004-887 that amends resolution 2004-854. Commissioner Graf asked if the Auditor's office staff could still change the assessments. Nancy Yackee said they could still get it done. Commissioner Genter seconded the motion. Commissioner Genter said that because it is listed on the tax bill, does it mean that a lien could be filed if you didn't pay your sewer bill. Mr. Robinson said that it is a two-point process but his opinion that having them listed on the tax bill as a special assessment should not be. Nancy Yackee asked if Mr. Robinson is saying that it should be re-worded on tax bills. Mr. Robinson stressed that is something that the county prosecutor needs to determine. Resolution 2004-887 carried unanimously. For the record Commissioner Graf stated that Mr. Robinson was not present representing the commissioners but was not invited to be here by the commissioners.
